1. Acceptance of Terms

By creating an account or using WastePlanner ("the Platform"), you agree to be bound by these Terms of Service. The Platform is operated by Pro Waste Consultants Pty Ltd ("PWC", "we", "us"). If you do not agree to these terms, do not use the Platform.

2. Description of Service

WastePlanner is a software-as-a-service platform providing waste management planning tools for the Australian property development industry. Tools include bin calculators, layout generators, swept path analysis, and AI-powered compliance checking.

3. AI-Generated Content Disclaimer

IMPORTANT: All AI-generated outputs from this Platform โ€” including compliance assessments, RFI comments, bin calculations, and advice โ€” are indicative only and do not constitute professional advice. They must not be relied upon as the sole basis for any planning application, development approval, or regulatory submission without independent verification by a qualified waste management consultant or relevant professional.

Pro Waste Consultants accepts no liability for decisions made based solely on AI-generated outputs from this Platform.

4. Free Plan, Subscriptions and Payment

New accounts start on the free plan: one project with all tools included, subject to the usage limits stated in the Platform. Paid subscriptions are billed monthly in advance. All prices are in Australian dollars and include GST where applicable. You may cancel your subscription at any time by contacting lachy@prowaste.au; cancellation takes effect at the end of the current billing period and your account reverts to the free plan, with your existing projects remaining readable and exportable. No refunds are provided for partial months.

Founding member pricing ($149/month) is locked for the life of the subscription provided the subscription remains active and is not cancelled.

5. Acceptable Use

You agree not to: (a) use the Platform for any unlawful purpose; (b) upload documents you are not authorised to submit for processing; (c) attempt to reverse engineer, scrape, or extract data from the Platform; (d) share your account credentials with others; (e) use the Platform to generate outputs for resale without written permission from PWC.

6. Intellectual Property

All Platform tools, algorithms, interfaces, and documentation are the intellectual property of Pro Waste Consultants. You retain ownership of documents you upload. You grant PWC a limited licence to process uploaded documents for the purpose of providing the service. PWC may use aggregated, anonymised data derived from platform usage for benchmarking and product improvement.

7. Limitation of Liability

To the maximum extent permitted by Australian law, PWC's total liability to you for any claim arising from use of the Platform is limited to the total subscription fees paid by you in the 3 months preceding the claim. PWC is not liable for any indirect, consequential, or incidental damages.

8. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Victoria.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated terms. Material changes will be notified by email.
